HOW DO YOU KNOW THE “LEGAL” CULTURE OF YOUR STATE, PRO- OR ANTI-GUN: INDIANA GOVERNOR MIKE PENCE SPORTING CLAYS EVENT

The legal position of a state governor provides a good insight into how various gun laws may be enforced and what to anticipate in terms of future gun laws. In Indiana, Mike Pence gained strong support in his recent bid to be elected governor from gun owners and sports enthusiasts by his stated commitment to Hoosiers’ right to keep and bear arms under the Second Amendment. Certainly, such a plank for election speaks to whether a Governor will veto nonsensical or unnecessary gun legislation. However, many compromises must often be made by any respected leader, Governor Pence is solid in his commitment to Hoosiers to secure their right to safely… Read More

A number of citizens who have been subject to violent crime, observed or were in a tragedy and members of our military pose frequent questions about how does treatment for PTSD impact their constitutional right to keep and bear arms. Does it preclude possession of a firearm? Could it? The answer is complex, but “it depends.” This blog post will outline the basic answers to these rhetorical questions1. California Gun Owners, Beware

Newly Amended Legislation Significantly Expands “Assault Weapon” Ban As previously discussed here, gun-control advocates wasted no time in exploiting recent crimes in Aurora, CO and Oak Park, WI to push for more restrictions on law-abiding citizens’ firearm ownership. The latest example comes from California. Senate Bill 249 was introduced last year as an agriculture bill, but was amended to ban so-called “assault weapon” conversion kits. However, SB 249 was further amended on August 7, 2012, re-directing the legislation into an expansion of the state’s so-called “assault weapon” ban. State Senator Leland Yee (D-8) authored the August 7 amendment to Senate Bill 249, broadening the description of so-called “assault weapons” by re-defining… Read More

We Didn’t Have to Wait Long for New Calls on Restricting Gun Rights

New York Congresswoman and gun-control champion Carolyn McCarthy (NY-4) wasted no time in introducing federal legislation that seeks to make it more difficult for gun owners to purchase ammunition. Controlling the amount of ammunition purchased and restricting the opportunities for making purchases of lawful products is certainly a way of constricting the ability of lawful citizens to take part in lawful activities. The first line of a press release from co-author Rep. Diana DeGette (CO-1) sets the tone quite nicely: “Rep. Diana DeGette (CO-1) and Rep. Carolyn McCarthy (NY-4) introduced new legislation to make the sale of ammunition safer for law-abiding Americans who are sick and tired of the ease with… Read More

Condolences to the Victims of Violence in Aurora, CO and Oak Creek, WI

Gun Laws by State Expresses our Deepest Condolences to the Victims of Violence in Aurora, CO and Oak Creek, WI The vast community of American firearm owners mourn the pain and loss of life when rogue individuals carry out horrific crimes against our fellow countrymen. In the wake of media reports of shootings in recent days and weeks, some forget that these criminals are NOT the norm among American firearm owners. Others purposely distort the emotional events to paint a black stain against American firearm ownership and those who choose to exercise the Second Amendment. The violence carried out in the theater in Aurora and the Sikh temple in Oak… Read More
