Are You Using The Current ATF 4473 Form?

Would You Bet Your License On It? 

There is an old adage, “The only constant is change”. This true with everything in life, and law in particular. Everyone who has followed firearms law understand this. The Assault Weapons Ban was enacted and then vanished by its sunset provision in 2004.

As Congress and its administrative agency, ATF, change laws, it sometimes requires a revision of the key form to purchase a weapon at retail, the ATF 4473 Form. With a change in the interpretation as it relates to the status of nonimmigrant aliens versus those admitted with a visa, the ATF 4473 Form had to be revised.

This revision occurred in April, 2012, and required the new version of the ATF 4473 Form to be used as of July 9, 2012. The form is available in e-format.1 For dealers who do not routinely deal with transfer and possession of firearms with persons with this status, it could be easy not to be too concerned about using the correct version of the AFT 4473 as of the date it is required.

Wrong.

The failure to use the correct version of the ATF 4473 form is a violation of the administrative regulations that FFL holders must follow. The failure to use the correct version of this form is non-compliance and can lead to sanction including revocation of your FFL.2

To promote the continued state of gun legislation and regulation, it is incumbent on all FFL holders to check the status of their forms (all forms, such as for multiple handgun purchases) and use the current version. This will protect your license and livelihood. The ATF 4473 Form and log book are the key to law enforcement officers performing their duties in tracking crimes committed with firearms.

Know your part and help by using the correct forms and stay clear of compliance violations.

Check your ATF 4473 Form version today. It should state in the lower right hand corner “Revised April 2012″.
